1. WHAT IS THE PREFERRED OWNER POINTS PLUS PROGRAM? WHAT IS THIS PROGRAM ABOUT?
The Preferred Owner "Points Plus" program is a free program offering a variety of ways you can save money when you shop with the Preferred Owner "Points Plus" program - you receive online coupon savings or Preferred Owner Service points to use at your dealership when you shop through the program web site.
2. HOW DOES IT WORK?
In order to save money through the program simply shop online with the links provided. Don't forget you can earn Preferred Owner Service points, too! Every time you shop at a Preferred Owner Points Plus retailer through the program web site, you earn Preferred Owner Service points, which will be added to your Preferred Owner Service Point balance. Points earned may be redeemed the same way as your Preferred Owner Service Points. Points will not be awarded for taxes or shipping. Please refer to your dealership's Preferred Owner terms and conditions for details.
3. WHO IS ELIGIBLE FOR THE PREFERRED OWNER "POINTS PLUS" PROGRAM?
This program is open and offered only to Preferred Owner members who are legal residents of the 50 United States and the District of Columbia.
4. CAN I CANCEL MY MEMBERSHIP AT ANY TIME?
Please remember that the Preferred Owner "Points Plus" program is free to participate in, so why not earn points toward future service visits! There is no action required if you wish to discontinue earning Preferred Owner Points. If you wish to cancel your membership in the Preferred Owner Program, please contact your dealership.
5. WHAT IS THE COST TO PARTICIPATE?
Not a thing! There is no membership fee for the Preferred Owner "Points Plus" program.
6. HOW LONG DOES IT TAKE TO SEE THE PREFERRED OWNER POINTS PLUS REWARDS THAT I'VE EARNED?
If you do not see your point rewards posted within approximately 15 days after your order is shipped, please contact us. Note: Your Points Plus points for Travel purchases will post approximately 15 days after your travel date.
7. HOW DO I RECEIVE MY PREFERRED OWNER POINTS PLUS REWARDS?
Preferred Owner "Points Plus" rewards are automatically added to your Preferred Owner Service Points balance. To view your accumulated points rewards go to our program's website, login, and click on "Transaction History."
8. WHERE CAN I SEE THE PREFERRED OWNER POINTS PLUS POINTS I HAVE ALREADY REDEEMED?
To view your total point rewards already earned, visit our program web site, click on "Transaction History" and scroll down to the "Service History" section. You will be able to view the total point rewards earned as well as a summary of each reward point processed.
9. WHAT HAPPENS IF I RETURN MY PURCHASE, DO I KEEP THE REWARD POINTS?
Any returns or credits related to your purchases at a Participating Retailer will be deducted from your spending at such Participating Retailer for points accumulation purposes, or will result in a deduction of Preferred Owner "Points Plus" rewards already accumulated.
10. DO MY POINTS PLUS POINTS EXPIRE?
Yes, Your Points Plus points expire 3 (three) years from the transaction date.

TERMS AND CONDITIONS OF THE NIELSEN CHEVROLET PREFERRED CUSTOMER PROGRAM
Overview of Nielsen Chevrolet "Preferred Customer Program" ("PROGRAM").
Nielsen Chevrolet's Preferred Customer Program is a customer loyalty program by which participating customers can earn points toward future of vehicle, or service and parts purchases. All points earned under the Program can ONLY be used at the Nielsen Chevrolet dealership. Points earned under the Program cannot be used at any other dealership, and are not redeemable for cash. Points expire three (3) years from the date of issue, and Points are not transferable.
Participation in the Program.
Retail customers who are 18 years of age and (i) purchase a vehicle or (ii) have service performed on their vehicle at Nielsen Chevrolet are eligible to participate in the Program and became a "Preferred Customer." Employees, Fleet Customers, and Wholesale Customers are not eligible for Car Points, and are only eligible to participate and earn Service Points via purchases online through the Program. Invitation to the Program will be extended in person by our Sales and Service Departments to qualified participants. Participation by a Preferred Customer in the Program shall constitute full and unconditional acceptance and agreement to these Terms and Conditions. Personal information collected in connection with the Program will be used in accordance with the Nielsen Chevrolet Privacy Policy, a copy of which is available upon request.
Earning Program Points (Car Points and Service Points).
Every Preferred Customer upon enrollment receive 250 Car Points which can used as credit toward the future purchase of a new or used vehicle from Nielsen Chevrolet. Preferred Customers earn Service Points toward future service and parts at Nielsen Chevrolet from the purchase of service and parts at Nielsen Chevrolet. These Service Points are equal to 3% of each retail service and parts purchase (excluding shop supplies and wholesale transactions) from Nielsen Chevrolet, and can be used toward future service or parts transactions. Additional bonus Service Points can also be earned from purchases made online from over 400 participating retailers available through the Preferred Customer Portal via your online account, which is established at the time of enrollment. One bonus Service Point is awarded for each dollar spent via the Preferred Customer Portal.
Overview of Nielsen Chevrolet "Preferred Customer Program" ("PROGRAM").
• Car Points can only be used as a credit toward the purchase of a new or used vehicle from Nielsen Chevrolet.
• Service Points can be used as a credit toward service or parts transactions with Nielsen Chevrolet.
• Car Points and Service Points are not interchangeable. Car Points cannot be used toward service or parts transactions. Service Points cannot be used toward the purchase of a vehicle.
• Each Program point is eligible for a credit of one dollar off the cost of a qualifying transaction.
• All Points expire 3 years from the date of issue.
• Program Points have no independent cash value and are not redeemable for cash.
• Parts and service purchased with Program Points cannot be returned for cash, and may only be returned for Program Points.
• Program Points are non-transferable.
• Program Points can only be used at Nielsen Chevrolet.
Program points may not be used or combined with any other advertised offer
Modification and Termination of the Program, Reserved.
Nielsen Chevrolet reserves the right to modify any of the Terms and Conditions governing the Program, including, but not limited to how Points can be earned, how the Points can be used, and the value to be assigned to Points, at any time, without notice, even if such changes affect a Preferred Customer's ability to use Points earned. Please take notice that no pre-determined termination date for the Program has been established, and Nielsen Chevrolet reserves the right to terminate the Program at any time, without notice to participants. Notwithstanding the foregoing, current Terms and Conditions of the Program will be available on the Preferred Customer website, and will supersede all previous versions of the Terms and Conditions. Continued participation in the Program by a Preferred Customer after modification of the Terms and Conditions, shall constitute full acceptance of and agreement to those modifications. Preferred Customers are responsible to review the current Terms and Conditions available on the Preferred Customer Program Website.
General Terms and Conditions.
Accrued Points do not constitute property of a Preferred Customer and have no value outside of the Program. All Points earned under the Program remain the property of Nielsen Chevrolet and constitute credits which may be revoked or modified by Nielsen Chevrolet any time, as set forth herein. Points may not be exchanged for cash, assigned, bartered, or transferred, and are not transferable upon death, as part of a domestic relations matter, or otherwise by operation of law. Each Preferred Customer is responsible for monitoring that Customer's account information for accuracy.
Limitation of Liability.
By participating in the Program, each Preferred Customer accepts all responsibility and liability for participation in the Program, and hereby agrees to indemnify and hold harmless Nielsen Chevrolet, its related companies, General Motors, Maritz, and their respective officers, directors, employees, shareholders, agents, successors, and assigns (the "Released Parties"), from and against any claims which may arise from participation in the Program, including, but not limited to actions or omission of the Preferred Customer, liabilities of the Preferred Customer, and actions of third parties, including unauthorized access to Preferred Customer's account information.
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM OR OUT OF THE PROGRAM, EVEN IF ANY OR ALL OF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SUCH EXCLUSIONS MAY NOT APPLY TO YOU. IF A PREFERRED CUSTOMER PROVES THAT NIELSEN CHEVROLET HAS IMPROPERLY DENIED THAT CUSTOMER EARNED POINTS, THE LIABILITY OF NIELSEN CHEVROLET SHALL BE LIMITED TO THE EQUIVALENT AMOUNT OF CREDIT UNDER THE CURRENT TERMS AND CONDITIONS OF THE PROGRAM. BY PARTICIPATING IN THE PROGRAM, A PREFERRED CUSTOMER WAIVES ANY STATUTORY STATUTE OF LIMITATIONS AND WAIVES ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION, AND OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED, EVEN IF THAT CLAIM WAS UNKNOWN AT THE EXPIRATION OF THE ONE (1) YEAR. PARTICIPANTS IN HE PROGRAM WAIVE ANY "DISCOVERY RULE" WHICH WOULD OTHERWISE EXTEND THE AGREED UPON ONE (1) YEAR PERIOD OF TIME WITHIN WHICH TO BRING A CLAIM.
Legal Disputes.
Preferred Customer assert a claim, at law or in equity that, relating to or arising out of the Program ("Claims"), via arbitration, court, or as otherwise mutually agreed upon in writing by the parties, as set forth below.
Arbitration. Preferred Customers shall resolve any monetary Claim for less than $10,000, which does not involve injunctive or other equitable relief, through binding arbitration that does not require a personal appearance and may be conducted by telephone, online, and/or based solely upon written submissions. Any award rendered by an arbitrator may be entered in any court having jurisdiction thereof. Arbitration shall be conducted pursuant to the Federal Arbitration Act ("FAA"), to the extent that the FAA is not inconsistent with New Jersey law. Court. Claims for more than $10,000, or which involve injunctive or other equitable relief, shall be adjudicated in a court of competent jurisdiction located in Morris County, New Jersey. Preferred Customers agree to submit to the personal jurisdiction of the courts located within the Morris County, New Jersey, irrespective of where a Preferred Customer may reside. Applicable Law. As the agreements entered into and are to be performed entirely within the State of New Jersey, these Terms and Conditions are to be governed by and interpreted under the laws of the State of New Jersey, irrespective of where a Preferred Customer may reside.
Headings. Headings are for reference purposes only and shall not be interpreted or used to define, limit, construe or describe the scope or the extent of a section.
Waiver. The failure of Nielsen Chevrolet to enforce any portion of the Terms and Conditions shall not be interpreted as a waiver of that provision, excuse a breach of the Terms and Conditions by a Preferred Customer, or act as a waiver its rights to act with respect to subsequent or similar breaches.
Entirety. The Terms and Conditions and any documents incorporated by reference sets fully the full and complete understanding between the parties with respect to the Program.
Partial Invalidity. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect. Any ambiguities shall be interpreted in an manor as to comply with all applicable laws and avoid invalidity of the provision.
